rednote Privacy Policy

Introduction

Welcome to rednote. This Privacy Policy applies to rednote services, which include rednote App, website, software and related services (the "Platform"). The Platform is controlled by Rednote Technology PTE. LTD registered at TRIVEX 8 BURN ROAD #04-004 Singapore 369977. ("rednote", "we" or "us").

We are committed to protecting and respecting your privacy. This Privacy Policy explains how we collect, use, share, and otherwise process the personal information of users, and other individuals.

This Privacy Policy applies to you only if you are registered outside Chinese mainland, meaning that you are a rednote user.

This Privacy Policy will not apply to you if you are registered in Chinese mainland, meaning that you are a Xiaohongshu user. If you are a Xiaohongshu user, the processing of your personal information shall be subject to the Xiaohongshu User Privacy Policy instead of rednote Privacy Policy.

1. What Does rednote Do?

The rednote Platform is a lifestyle platform, with the mission to "inspire lives to share and discover the wonders of the world". Users can record moments of their lives and share their lifestyles through short videos, pictures, texts and other forms of content, and form interactions based on interests.

2. What Information Do We Collect?

We may collect your personal information in three ways:

(1) Information that you provide (depends on different features)

Do We Process Any of Your Sensitive Information?

Please note, in some jurisdictions, certain types of information may be sensitive or may constitute special categories of data/personal information. For example, personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership; this also includes genetic data, biometric data for the purpose of identifying a unique natural person, data concerning health or data concerning a natural person's sex life or sexual orientation.

We generally do not require sensitive information to allow users to use basic function of our Platform, and this means that you can freely control and decide whether to provide such sensitive information to us. However, please be notified that if you choose to publish content about these topic in your User Content, they may be visible to other users and the public.

However, in specific circumstances, we may process your sensitive information with your consent or on other legal bases. The applicable legal basis depends on the specific situation and purpose, and we will inform you accordingly. For example, we may process biometric data with your consent for risk control and verification purposes, or collect precise geolocation data with your consent to enhance your user experience.

3. How Do We Use Your Information?

As outlined, we use your information to facilitate your use of the Platform, to improve, support and control this Platform, to allow you to use and control its functionalities and features, and to fulfill and enforce our Terms of Service.

We may also use your information for sharing the User Content with you, including personalized content and personalized recommendations, and also to promote our Platform, and to provide Ads.

4. Who Do We Share Your Information With?

Our Corporate Group

We may share your information with other members, subsidiaries, or affiliates of our corporate group, including to provide the Platform and its services, to improve and optimize the Platform, to prevent illegal use and to support users. Specifically, Xiaohongshu Platform operating in China will be interoperable with rednote Platform; this means that public User Content and profile can be shared and accessed by a user of Xiaohongshu platform, and you can communicate, interact with a user of the Xiaohongshu platform.

Our Service Providers

We may engage with service providers to provide you with different services on behalf of us; e.g. IT support, content moderation, account verification, cloud storage services, data analytics, and other services. This is to enable us to operate this Platform in a safe and efficient way, and to help us market our Platform.

Public Profiles

Your profile would be fully visible to anyone on the Platform by default; this means that your User Content, your saves, your following/followers can be accessed. You can change your privacy settings to hide your saves and/or following/followers information. You can also change the visibility of your notes by selecting the relevant note on your profile, clicking [three-dot icon] - [Privacy Settings].

Actual or Potential Buyers

We may share your information with actual or potential buyers (and their agents and advisers) in connection with any actual or proposed purchase, merger or acquisition of any part of our business, provided that we notify the buyer that they must use your personal information only for the purposes disclosed in this Privacy Policy.

Legal Obligations

We may disclose your information to any competent law enforcement body, regulatory body, government agency, court or other third party, where we believe such disclosure is necessary: (i) in accordance with applicable laws or regulations; (ii) to exercise, establish or defend our legal rights; or (iii) to protect your vital interests or those of any other individual.

Independent Researchers

We may share your information with independent researchers to support their research that meets certain standards.

5. Data Security

We take the security of your personal data very seriously and implement appropriate technical and organizational measures to protect the personal information we collect and process. The measures we implement are intended to ensure a level of security that is appropriate to the risks associated with processing your personal information. For example, de-identification, strict encryption access control, and other security measures. We maintain these technical and organizational measures and periodically update them to enhance the overall security of our systems.

In addition, we restrict access to your personal information to employees, agents, contractors, and other third parties who have a legitimate business need to know. They process your personal information solely in accordance with our instructions and are bound by confidentiality obligations. We use industry-wide recognized standard measures to safeguard all data storage and processing. We maintain an ongoing process to assess the effectiveness of these measures and to review emerging threats and available security tools.

However, you also play an important role in maintaining the security of your data. We remind you to take prudent measures to protect against unauthorized access to your account information, including logging out after use, keeping your login credentials confidential, and adopting other customary security precautions appropriate to the circumstances.

Please be aware that we operate as a global platform and community. There may contain links to external sites that are not operated by us on our platform. If you click on a third-party link, you will be directed to that third-party's site. We strongly advise you to review the Privacy Policy and terms of service of every site you visit. We have no control over, and assume no responsibility for the content, privacy policies or practices of any third-party sites, products or services.

6. Data Retention Period

We retain your personal information as long as necessary to fulfill the purposes outlined in this Privacy Policy. We also retain information when required to comply with contractual and legal obligations, when we have a legitimate business interest (such as improving and developing the Platform and enhancing its safety, security and stability), or for establishment, exercise, or defense of legal claims.

The retention periods are different depending on different criteria, but as a general principle, if you are still a user of our Platform, we will keep your account information until you choose to delete your account, or until your account is suspended or closed due to legal reasons (e.g. if you violate our Terms of Services or other guidelines, conditions and policies). In certain circumstances, we may be required by law to retain your information for a longer period.

For legal reasons, even you choose to delete your User Content, we may need some time to help you with completing the procedures due to following reasons:

The exact retention period depends on the specific circumstance, once it is compliant to delete your User Content and/or your account, we will do so immediately.

When we no longer have lawful, reasonable and informed purposes for processing your personal information, we will delete or anonymize it as soon as reasonably possible.

7. International Data Transfers

You acknowledge that we operate as a global platform and community. To support your needs and enhance your experiences on our Platform, your personal information may be transferred to, and processed in, countries other than your country or region of residence. These countries may have data protection laws that differ from those in your country.

Our servers for providing service to you are located in Singapore. However, we may process your personal information in our group companies, service providers, and partners that operate worldwide.

We will comply with applicable data protection laws regarding international data transfers. This may include entering into data transfer agreements incorporating legally required standard contractual clauses and implementing other appropriate security measures. Our data recipients are also obligated to comply with applicable data protection requirements alongside us.

8. Children and Teens

Our Platform is not specifically designed for children. If a child is not qualified as a person who can solely and freely give consent to using social media or information services, their parents or guardians shall decide whether the child may download and use rednote. After downloading our Platform, as a new user, you are required to provide your date of birth to us for age verification purposes. As a principle, we do not allow any children under the age of 13 to register or use our Platform. We may have different practices due to different legal requirements across jurisdictions.

In accordance with our policies and applicable law, you may be required to provide proof of your age in order to access our Platform or certain content or features within our Platform. Currently, we partner with k-ID to support age verification, who provides technologies designed to create safer, more empowering online experiences for kids and teens. The methods you use to prove your age may vary based on where you live. Regardless of which method or methods you use to verify your age, we only receive and store the results of the verification process. Neither we nor k-ID retain any personally identifiable information you provide to prove your age.

If any parent or guardian wishes to submit a complaint or claim regarding the processing of personal data of children or minors, or if you believe that a user is under the age of 13 (or other applicable minimum age required by local laws in certain jurisdiction), please contact us at customer_support@rednote.com. We are continuously improving our Platform and its features to provide a safer and better experience for children and teen users.

9. Your Data Protection Rights

In accordance with applicable laws, you have certain data protection rights, which include, at a minimum, the right to access, delete, update, or correct your personal data, to be informed about its processing, to lodge complaints with relevant authorities, and, where applicable, other rights such as withdrawing your consent, or objecting to or restricting certain processing activities (e.g., processing for AI training) as required by law. Please refer to the Supplemental Terms below for further details in different jurisdictions.

You may exercise these rights by contacting us via the contact details provided under the "How to contact us" section below. We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws.

To some extent, you may also use functions on the Platform to change your privacy settings or preferences: You can choose to follow or unfollow Accounts based on your preferences, or edit, change or delete some of your data in your account and also the User Content you posted, you can also change your privacy settings to manage your mobile permissions, and to control and manage who can view your videos, send you messages, or post comments to your videos. You can also change your settings on personalized recommendations and choose to opt-out of marketing.

10. Updates to This Privacy Policy

We may update this Privacy Policy from time to time in response to changes in legal, technical, or business developments. When we make updates to our Privacy Policy, we will take appropriate measures to inform you, in accordance with the significance of the changes. Where required by applicable data protection laws, we will obtain your consent for any material changes to the Privacy Policy.

You can check when this Privacy Policy was last updated by referring to the "Effective date" displayed at the top of this Privacy Policy.

12. Jurisdictions' Supplemental Terms

In the event of a conflict between the provisions of the Jurisdiction's Supplemental Terms applicable to your location and the provisions of this Privacy Policy, the Jurisdiction's Supplemental Terms shall prevail and govern.

12.1 EU/EEA Addendum

If you are using the Platform in the EU/EEA, the following additional terms shall apply.

2. Legal Base for Processing Your Data

If we have entered into a contract with you and the processing is necessary for us to fulfil our contract with you or take steps at your request prior to entering into the contract, the lawful basis is that it is necessary per Article 6(1)(b) GDPR.

If the processing is necessary for us to comply with an applicable legal obligation under the GDPR, the lawful basis is that it is necessary per Article 6(1)(c) GDPR.

Under certain circumstances, the processing is necessary for us to realize a legitimate interest based on an assessment of that interest of your privacy and other fundamental interests. In these cases, the lawful basis is that it is necessary per Article 6(1)(f) GDPR. You can choose to control this via [three lines icon] - [Settings] - [Privacy Settings].

Under certain circumstances, we rely on your consent to process your personal data, per Article 6(1)(a) GDPR. In such cases, you may withdraw your consent at any time by emailing us at customer_support@rednote.com.

We will also need your information to protect your vital interest or other's vital interest, the lawful basis is that it is necessary per Article 6(1)(d) GDPR.

We will also process your information where it is necessary for the performance of a task carried out in the public interest, the lawful basis is that is necessary per Article 6(1)(e) GDPR.

3. Children or Minor Users

If you are a minor under the age of 13, you are not permitted to create a rednote user account in the EU/EEA. If a minor cannot provide consent independently due to age requirements that differ across EU Member States, we will comply with the specific age thresholds applicable in each Member State and conduct appropriate age-verifications before allowing access to or use of our Platform.

If you are a user under the age of 18 in EU, we will not provide you with personalized Ads that may target you.

If you are a parent of a child or minor user, we kindly remind you to exercise caution when sharing any personal data of a child — whether or not the child is your own. Please be aware, your account may not be private, and your User Content may be viewable by other users and the public.

4. Data Transfers outside of EU/EEA

Your data will be collected and stored by us in Singapore. However, since we need to work with our group companies, affiliates, and third-party partners, your data may be transferred from Singapore to countries outside the EU. When we conduct transfer data outside of EU, we will rely on adequacy decisions, Article 49 of GDPR derogations for specific situations, or the Standard Contractual Clauses (SCCs). 5. Your Data Protection Rights in the EEA

In the EEA, you have the following rights, subject to conditions under the GDPR and/or any local data protection laws:

12.2 US Addendum

States Except for California

Unless stated otherwise, this section applies to residents of U.S. states whose privacy laws apply to us and grant the rights described below (collectively, the "State Privacy Laws").

Depending on where you live and subject to the conditions under the applicable State Privacy Laws, you may have the following rights with respect to the personal data that we have collected from or about you:

A. Right to Know About Your Personal Information

You have the right to request that we disclose what personal information we collect, use, disclose and sell about you specifically ("right to know"). To submit a request, please email customer_support@rednote.com and include "California Request to Know" in the subject line.

B. Our Personal Information Handling Practices over the Preceding 12 Months

We have collected the following categories of personal information about California residents in the preceding 12 months: Identifiers; Commercial information; California customer/consumer records; Internet or Network Information; Geolocation data; Audio, electronic, visual or similar information; Inferences drawn from personal information; and Sensitive Personal Information. This information is used for service delivery and operations, research and development, marketing and advertising, service improvements and analytics, and compliance and protection. It is disclosed to service providers, advertising partners, business transferees, professional advisors, authorities and others, and other users and the public, as described in this Privacy Policy.

C. Right to Request Deletion of Personal Information

You have a right to request the deletion of personal information that we collect or maintain about you. Please email customer_support@rednote.com and include "California Request to Delete" in the subject line.

D. Right to Request Correction of Personal Information

You have a right to request the correction of personal information that we collect or maintain about you. Please email customer_support@rednote.com and include "California Request to Correct" in the subject line.

E. Right to Opt-Out of Selling/Sharing of Personal Information

You may exercise your right to opt out of the "sale" and "share" of your personal information by clicking [three lines icon] - [Settings] - [Privacy Settings] - [Personalized Options] and toggling off [Enable Ads Personalization]. You may also submit an opt-out request by sending an e-mail to customer_support@rednote.com. Rednote does not have actual knowledge that it "sells" or "shares" the personal information of consumers under 16 years of age.

F. Right to Non-Discrimination

You may not be discriminated against because you exercise any of your rights under the CCPA.

G. Verification Process and Authorized Agents

Only you, or someone legally authorized to act on your behalf, may make a request related to your personal information. You can designate an authorized agent to make a request under the CCPA on your behalf if: (i) the authorized agent is a natural person or a business entity registered with the Secretary of State of California; and (ii) you signed a written declaration that you authorize the authorized agent to act on your behalf.
